Hazardous waste generators shall retain copies of all manifests signed off by the disposal facility and <br /> all receipts used in a consolidated manifesting procedure on site for three years and have them readily available for <br /> review. Immediately locate a copy of all manifests and receipts for the last three years, maintain them on site, and <br /> submit copies to the EHD. <br /> This is a Class II violation. <br /> 123 HSC 25185(c)(3) Failed to submit a written response within 30 days of receiving an inspection report. <br /> An inspection was last done on April 11, 2012 and an inspection report was issued identifying information to be <br /> submitted to bring this site into compliance. This information (the outstanding violation concerning violation 31 "failed <br /> to comply with the tank assessment requirements")was required to be submitted to the EHD 30 days from the receipt <br /> of the full inspection report. This information has not been received resulting in a non-compliant status for this facility. <br /> An operator that receives an inspection report shall have 30 days to submit a written response that includes a <br /> statement documenting corrective actions taken or proposing corrective actions which will be taken. A copy of the <br /> revised tank assessment report was received at the time of inspection. Mr. Souza indicated that he was certain that <br /> this information was already provided to the EHD. Ensure that a written response documenting corrective actions <br /> taken or proposed is submitted within 30 days of receiving an inspection report. This was corrected on site. <br /> This is a Class II violation. <br /> 205 HSC 25250.7 Failed to manage used oil contaminated with other hazardous waste as hazardous waste. <br /> Used oil contaminated with hazardous waste was not handled as hazardous waste. According to Mr. Souza, waste oil <br /> is drained from vehicles along with other vehicular fluids (diesel, coolant, etc.) into a single drain pan container. At <br /> present, waste oil is being transported offsite using a consolidated manifesting procedure and is not being handled as <br /> hazardous waste. If used oil is contaminated with a hazardous waste, the resulting mixture shall be managed as <br /> hazardous waste. Immediately begin handling all used oil contaminated with hazardous waste as hazardous waste, <br /> or provide proof that the resultant waste oil mixture qualifies to be disposed of as used oil and not hazardous waste. <br /> Submit proof of correction to the EHD. <br /> This is a Class II violation. <br /> 301 CCR 66265.31 Facility not maintained to minimize the release of a hazardous waste. <br /> Pooling of oily liquid was noted next to the outside wall of the metal walk in container which houses the waste oil tank. <br /> Facilities shall be maintained and operated to minimize the possibility of a fire, explosion, or release of hazardous <br /> waste to air, soil, or surface water which could threaten human health or the environment. Immediately fix any leaks <br /> and clean-up the pooling oil , and manage all waste according to Title 22 hazardous waste regulations.
