Fremont, Stockton <br />SUMMARY OF VIOLATIONS <br />CLASS 1, CLASS II, or MINOR -Notice to Comply) <br />30. (Repeat) Observed one 55 -gallon empty HW or Hazardous Material (HM) container in the <br />maintenance shop, one 30 -gallon empty HW or HM container outside the tire shop, and at least nine 55 - <br />gallon empty HW or HM containers in the scrap yard at the southeast corner of the property. None of <br />the empty containers were marked with the date when they first became empty. <br />-- Containers larger than five gallons that previously held a hazardous material shall be marked with <br />the date they were emptied and managed within one year of being emptied. <br />* Immediately manage the above empty HW or HM containers by disposing, recycling, or reuse. <br />Begin marking and managing all future empty containers per this section. Submit evidence of correction <br />to EHD by November 21, 2010. <br />32. (Repeat) HW Tank Assessment Report dated January 21, 2009 is missing the following information: <br />o The method used to determine the thickness of the HW above ground tank (AST). <br />o Corrosion protection. "None", which is what was stated in the report, is inaccurate. <br />o Hazardous characteristics of the stored HW. <br />o Description of leak detection equipment. <br />o Description of spill prevention or overfill equipment. <br />o Estimated remaining service life of the AST based on the tank assessment information. The <br />report currently states "The manufacture states that the tank life for this type of use is 50 years <br />from date of manufacture" This statement does not make an estimate of the service life of the <br />AST. <br />— Owner of HW tank installed after July 1991 shall obtain and keep on file at the facility a HW tank <br />assessment that was reviewed and certified by an independent, qualified professional engineer. <br />The assessment is valid for a period of five years. The assessment shall include the following <br />information: 1) Tank configuration, 2) design standards, including be not limited to material <br />thickness, and method used to determine thickness, 3) age of the tank system, 4) description of <br />any leak detection equipment, 5) description of any corrosion protection equipment, 6) description <br />of any spill prevention or overfill equipment, 7) description of the secondary containment system, <br />8) hazardous characteristics of the wastes, 9) documentation of the inspection by the engineer on <br />including weld cracks, scrapes of protective coatings, corrosion, any structural damage, 10) tank <br />integrity test, and 11) estimated remaining service life of the tank system based on the findings of <br />the above #1 to 10. <br />* Submit by November 21, 2010 to EHD a copy of an updated HW tank assessment per this section. <br />If you are unable to obtain the tank assessment by the above date, submit to EHD before the <br />deadline the status of your endeavor and an estimate time when the tank assessment could be <br />submitted. <br />ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE $1221. <br />THIS FACILITY IS SUBJECT TO REINSPECTION AT ANY TIME AT EHD'S CURRENT HOURLY RATE. <br />EHD Inspector- <br />Received BT _ <br />RI <br />Title: <br />G' <br />EHD 23-02-003 Rev 08/10/1 CONTINUATION FORM <br />
