Manifest number 012413331JJK (4/15/14)was found without a signed off copy from the destination facility. Hazardous waste generators shall retain copies of all manifests signed off by the destination facility on site for three years and have them readily available for review. If the generator did not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste was submitted within 35 days of the date the waste was accepted by the initial transporter, the generator shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the waste. If the generator did not receive a copy of the signed off copy of the manifest within 45 days of the date that the waste was accepted by the initial transporter, the generator shall submit an Exception Report that includes a legible copy of the missing manifest, and a cover letter signed by the generator explaining the efforts to locate the hazardous waste and the results of those efforts. Exception reports shall be submitted to: DTSC Report Repository Generator Information Services Section P.O. Box 806 Sacramento, CA 95812-0806 Immediately locate a copy of the missing manifest or prepare and submit an exception report to DTSC. Submit to the EHD a copy of the signed off copy of the manifest or a copy of the exception report submitted to DTSC. This is a repeat violation, Class 11. 116 Failed to follow all consolidated manifesting procedures. Copies of hazardous waste disposal records for parts washer waste were not found on site. Hazardous waste generators shall retain copies of all manifests signed off by the disposal facility and all receipts used in a consolidated manifesting procedure on site for three years and have them readily available for review. Immediately locate a copy of all manifests and receipts for the last three years, maintain them on site, and submit copies to the EHD. This is a repeat violation, Class 11. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by October 11, 2014. Consent to perform the inspection, take photos and collect samples was given by Steve Schamaun, Project Engineer. This facility generated 31.88 tons of waste in the last calendar year (Jan-Dec 2013). The facility has so far generated 20.26 tons of hazardous waste in 2014. Please be aware as of January 1, 2013, all businesses are required to submit all hazardous materials information online to the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov. Be sure to include your hazardous waste activity in the Businesses Activities section in CERS in addition to any other relevant activities and required fields.
