been corrected. Mr. Backus called and spoke with Ms. Marie Jordan of California Fuel <br />Supply, Inc., which owns the Country Club 76 Gas Station. She asked Mr. Backus to <br />send all information to Mr. Dave Hinds, also of California Fuel Supply, Inc., by fax. Later <br />that day, Mr. Hinds stopped by the EHD office and submitted a packet of documents that <br />included a return to compliance certification, a statement that the previous alarms were <br />caused by programming issues of the monitoring panel and that Central Petroleum <br />Maintenance reprogrammed the monitoring panel on February 19, 2009, a log of <br />employee training by the designated operator, service receipts from Central Petroleum <br />Maintenance dated February 6, 18, and 20, 2009, current financial responsibility <br />documents, and a designated operator statement (Attachment 6). Mr. Backus gave Mr. <br />Hinds blank monitoring and response plans, and facility and tank forms and asked that <br />he complete and submit them. Mr. Backus also reminded Mr. Hinds to schedule the <br />annual monitoring system certification. <br />On April 27, 2009, Mr. Backus called Mr. Hinds and told him that a permit application <br />was required if Central Petroleum Maintenance had reprogrammed the monitoring panel <br />in February 2009. Mr. Backus emailed a copy of the permit application to Mr. Hinds. <br />On May 19, 2009, Mr. Backus witnessed the monitoring system certification, leak <br />detector testing, and spill container testing, all performed five months late. The <br />monitoring plan was incorrect and incomplete, and the UST — facility and UST — tank <br />forms were on outdated forms. The 91 -octane fill sump contained three gallons of liquid <br />and the sensor was sifting on a high point of the top of the tank and not located at the <br />lowest point to detect a leak at the earliest opportunity. The 87 -octane fill sump sensor <br />was also located in a similar manner, though Mr. Backus did not note it in the report. <br />Photos were taken of these two sumps (Attachment 7).
