On September 24, 2009, Mr. Backus witnessed the successful testing of the new 87 -
<br />octane leak detector (Attachment 3). While on site, the tank owner and operator, Mr.
<br />Fassel M. Elder, submitted the financial responsibility documents to Mr. Backus
<br />(Attachment 4).
<br />On September 28, 2009, copies of the May and June 2009 designated operator monthly
<br />inspection reports were submitted (Attachment 5).
<br />On October 23, 2009, Mr. Backus sent a follow up letter by certified mail to Mr. Elder
<br />requesting that the remaining items required on the August 27, 2009, UST inspection
<br />report be submitted (Attachment 6).
<br />On November 2, 2009, the December 23, 2008, secondary containment test report,
<br />August 27, 2009, monitoring system certification test, and designated operator employee
<br />training records for Ann and Fassel Elder dated June 11, 2009, were submitted
<br />(Attachment 7). Line tightness testing of the 87 -octane piping or programming shutdown
<br />of the pump when the 87 -octane piping sump sensor detects a leak was not addressed.
<br />On August 27, 2010, Mr. Backus received a call from Ms. Sandi Nimmo of Afforda-Test
<br />cancelling a monitoring system certification that was scheduled for August 31, 2010.
<br />Ms. Nimmo stated that a vehicle crashed through the store wall and disabled the store's
<br />electricity service. Mr. Backus drove by the facility and verified that the store was
<br />boarded up and not operating (Attachment 8). Mr. Backus called Mr. Elder, who
<br />explained that the accident occurred on August 16, 2010, and that electrical power
<br />would be out for the next three weeks. Mr. Backus told Mr. Elder that the LIST
<br />monitoring system needed to be restored and if repairs were needed, a permit would be
<br />required to be submitted to the EHD. Mr. Elder stated he would be at the facility every
<br />day. Mr. Backus sent a Notice to Abate Immediately (NAI) by certified mail to the facility
<br />address to restore monitoring of the LIST system immediately (Attachment 9). As of
<br />September 17, 2010, the certified mail receipt was not received by the EHD.
<br />On September 17, 2010, Mr. Backus resent the August 27, 2010, NAI by certified mail to
<br />Mr. Elder's home address. On September 21, 2010, the EHD received the certified mail
<br />receipt (Attachment 10).
<br />On October 28, 2010, Mr. Backus received a call from Mr. Elder. Mr. Elder indicated
<br />that Reliable Petroleum would repair the LIST monitoring system and apply for the repair
<br />permit with the EHD next week. A permit application was not submitted.
<br />On November 16, 2010, Mr. Backus received a call from Mr. Tim Stometta of Alpha
<br />Petroleum. Mr. Stometta stated that he was bidding on the project and asked questions
<br />about installing a new monitoring panel and liquid sensors. Mr. Backus described the
<br />permit application process and requirements.
<br />On December 7, 2010, Mr. Backus sent a NAI (dated December 6, 2010) by certified
<br />mail to Mr. Elder's home address to restore the UST monitoring system or to temporarily
<br />or permanently close the LIST system (Attachment 11).
<br />Attachments 12, 13, 14, and 15 include property owner information, facility operator
<br />information, tank owner information, and the UST facility file narrative, respectively.
