In determining whether a violation is <br />chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br />violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br />corrective action). <br />The secondary containment testing results from December 19-20, 2012 indicated a failure at UDC <br />and UDC 5/6. To date no repairs to the secondary containment or testing of the second <br />containment was conducted at this facility. The underground storage tank system must be operat <br />to prevent unauthorized releases, and all secondary containment for the UST system must be tight. <br />To avoid your system being Red Tagged, submit a permit application to the EHD by no later thar <br />March 2, 2015, to repair and subsequently retest the secondary containment components, complete <br />all necessary repairs and conduct the required secondary containment testing as soon as possible b� <br />no later than March 20, 2015.
