Per the attached Receipt of Key to Premises/Access to Personal Property form, you were provided <br /> access to the subject premises by delivery of keys on December 30, 2010, prior to execution of the Ground <br /> Lease. Enclosed herewith are all remaining keys in Landlord's possession for the Premises referenced. <br /> Therefore, upon receipt, Landlord has completed its delivery of the Premises to you. <br /> Enclosed for your review and signature are two(2) original copies of the Memorandum of <br /> Confirmation of Certain Ground Lease Terms (the"Memorandum")for the above referenced premises. <br /> Please carefully read and review each page. Please sign and return both originals in the enclosed self- <br /> addressed envelope. Once the Landlord has signed each document, we will forward a fully executed <br /> original to you for your records. <br /> As stated in the document please submit your payment for July rent in the amount of$1,800.00 on <br /> or before July 1, 2012. Beginning August 1, 2012, your Basic Rent will be $6,000.00 per month. <br /> Following are a few items we want to bring to your attention relative to the Memorandum and your <br /> Ground Lease tenancy as follows: <br /> 1. Although Section 3.4 of the Lease confirms the date of full Lease Execution is to be the Rent <br /> Commencement Date (4/1212012),the Memorandum revises this to be the date of Premises <br /> delivery, which date is June 22,2012. <br /> 2. Section 5 of the Lease does not define Basic Rent for the last five(5) years of the Lease(Months <br /> 301 —360), the Memorandum revises this to follow suit with negotiated terms of a fifteen percent <br /> (15%) increase to reflect Basic Rent at$12,068.13 per month. <br /> 3. The Certificate of Insurance we have for your Premises has expired and does not reflect the agreed <br /> upon coverages. Please have this corrected immediately.
