As you know, District Attorney David Irey, and San Joaquin County Environmental Health <br /> Department representative,Tuey Tran, require copies of daily monitoring receipts on a weekly <br /> basis. We have contracted with Gettler-Ryan to perform this monitoring on our behalf during the <br /> period up to the delivery of the Premised to you under the Ground Lease. Although you will be <br /> responsible for the charges for this service effective June 22, 2012,we will continue to have this <br /> monitored under contract through June 30, 2012 and will bill you accordingly for the period 6/22/12 <br /> —6/30/12. Thereafter, you will be responsible for the monitoring and reporting to these agencies. <br /> Please provide us written evidence of your contracting with a certified, licensed and insured <br /> monitoring company to provide this service. In accordance with the Ground Lease, Section 6.2, <br /> Compliance with Laws, you are required to comply with this provision. This must be provided to <br /> us no later than July 1, 2012. <br /> 5. Once you are ready to submit building plans to the City of Tracy, you are required to submit them <br /> simultaneously to Landlord for review and approval. This may be done electronically to <br /> jdutt@savemart.com. <br /> 6. The Second Amendment to Remediation and License Agreement with Phillips 66 is currently out <br /> for signature. Once this has been fully executed, a copy will be provided to you for your records. <br /> Please return the Memorandum by June 30, 2012.
