He informed me that the first submittal of <br />plans were received in Sept/Oct 2012. He wrote a deficiency letter for several items. During his review it was brought <br />to our department's attention that the remodel of the store would cover/impact the footprint of the waste oil <br />underground storage tank (UST) located to the west of the store. Mr. Huff stated that he just received the revised plans <br />yesterday that show a change for the store to be built around the waste oil UST. He also informed me that he is trying <br />to get the revised plan approved in the next ten business days. <br />As for our department, we are concerned about the proximity of the store to the tank pad. Construction on the <br />foundation could damage the waste oil UST. What will be the distance that the store will be built around the tank? <br />Another concern that needs to be addressed is the fact that the remodel of the store will not include an auto repair <br />business at this facility anymore. If the waste oil UST will continue to be used for storing waste oil, where will the waste <br />oil be generated from? Compliance with Hazardous Waste regulations/statutes must be achieved when the UST is <br />approved to operate. If the waste oil UST is found not to be in use, a permit application for closure must be submitted <br />to our department. <br />We have approved the permit application that was submitted to our department for upgrading the UST system for <br />Enhanced Vapor Recovery (EVR). According to Mr. Huff, the EVR upgrade is part of the Building Permit <br />application. Since he just received the plans yesterday, work cannot proceed until he approves the plans. Another <br />concern with the EVR upgrade and the store expansion is the fact that the vent piping that come from all of the UST's <br />are located along the west side of the building adjacent to the waste oil UST. If the vent piping needs to be relocated <br />because of the building expansion, an amendment to the approved permit application must submitted as well as a plan <br />of the new location for the vent piping. <br />Several other issues need to be resolved as outlined in the UST Official Inspection Report from July 5, 2012 that was <br />issued to and received by ABC Petroleum Inc., in the Notice to Abate from Nov. 1, 2012 that was issued and received by <br />ABC Petroleum Inc., and again in the UST follow up letter from Nov. 6, 2012 that was issued to and received by ABC <br />Petroleum Inc.: <br />1. Annual Monitoring System Certification —The last certification was performed on June 30, 2008. This <br />certification is required before the UST system can be approved to operate. <br />
