Defendant, in the course of Defendant's HOSPUAL activities is, pursuant to Health and <br />II safety Code section 25280 et seq., hereby permanently enjoined from: <br />a. Failing to annually test the spill containment structure, in violation of Health and <br />11 Safety Code section 25284.2; <br />b. Failing to prevent structural weakening of secondary containment, in violation of <br />!� Health and Safety Code section 25291(a)(2); <br />c. Failing to maintain monitoring system for water intrusion and for removing the <br />water, in violation of Health and Safety Code section 25291(e); <br />d. Failing to implement a monitoring program approved by the local agency and <br />specified in the underground storage tank operating permit, in violation of California Code of <br />Regulations, title 23 section 2632(b); <br />e. Failing to conduct monitoring on all underground pressurized piping with <br />secondary containment annually, in violation of California Code of Regulations, title 23 section <br />2636(f)(4); <br />f. Failing to perform periodic testing of secondary containment system, in violation of <br />California Code of Regulations, title 23 section 2637(a); <br />g. Failing to. submit a completed Monitoring System Certification form to the local <br />agency, in violation of California Code of Regulations, title 23 section 2638(d); <br />h. Failing to demonstrate to the satisfaction of the local agency that the conditions and <br />requirements specified in subsection 2660(k) will be met before upgrading an underground storage <br />tank system, in violation California Code of Regulations, title 23 section 2662(a); <br />i. Failing to retain a copy of the permit and all conditions and attachments, including <br />monitoring plans at the facility, in violation of California Code of Regulations, title 23 section <br />2712(i); <br />j. Failing to record results of each inspection by the designated underground storage <br />tank operator in a monthly inspection report, in violation of California Code of Regulations, title 23 <br />section 2715(c); <br />2 <br />PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
