N J 1. I activities, are pursuant to Health'and Safety Code section 25100 et seq.,hereby permanently 2 enjoined from: 3 a. Failing to properly label containers of hazardous waste,in violation of 4 California Code of Regulations,title 22,section 66262.34; 5 b. Failing to keep a copy of each signed manifest for three(3)years,or until the 6 generator receives a signed copy from the designated facility which received the waste,in 7 violation of California Code of Regulations,title 22,section 66262.40(a). 8 5. Defendants,in the course of defendants'GASOLINE SALES/MINI-MART activities, 9 are pursuant to Business and Professions Code§ 17204 hereby permanently enjoined from: 10 a. Violation of Health and Safety Code section 25280 et seq. described in 11 paragraph 3 above; 12 b. Violation of Health and Safety Code section 25100 et seq.described in 13 paragraph 4 above. 14 6. Defendants shall pay to plaintiff the sum of TEN THOUSAND FIVE HUNDRED 15 DOLLARS($10,500.00),as and for civil penalties,pursuant to Business and Professions Code 16 section 17206. Said payments shall be made navable to the TREASURER OF SAN JOAQUIN 17 COUNTY and a ivered to the San Joaquin County Office of the District Attorney, 18 Environmental Prosecutions Unit,as follows: 19 a. THREE THOUSAND FIVE HUNDRED DOLLARS($3,500.00), 20 on or before June 1,2008 21 b. SEVEN THOUSAND DOLLARS($7,000:00),on or before June 1,2009 22 7. Defendants shall pay to plaintiff the sum of TEN THOUSAND FIVE HUNDRED 23 DOLLARS($10,500.00),as and for civil penalties,pursuant to Health and Safety Code§25299. 24 Said payment shall be mamma able to the SAN JOAQUIN COUNTY ENVIRONMENTAL 25 HEALTH DEPARTMENT-ENVIRONMENTAL HEALTH DIVISION TRUST.
