ALLEGED VIOLATIONS <br />Underground Storage Tank Violations <br />C <br />sshih@sjcehd.com <br />mle@sjcehd.com <br />dwilson@sjcehd.com <br />Health & Safety Code (HCS) 25284(a)(1) Except as provided in subdivision (c), no person shall <br />own or operate an underground storage tank unless a permit for its operation has been issued by the <br />local agency to the owner or operator of the tank, or a unified program facility permit has been <br />issued by the local agency to the owner or operator of the unified program facility on which the tank <br />is located. <br />—*This facility operated without a permit after January 1, 2003. A photo of the facility in <br />operation was taken January 14, 2003. (Attachment 5) <br />California Code of Regulations (CCR) Section 2637(a) Secondary containment systems installed <br />prior to January 1, 2001 shall be tested by January 1, 2003 and every 36 months thereafter. <br />—>Secondary containment testing was not completed by January 1, 2003. <br />VI. ATTACHMENTS <br />1. On February 14, 2002, Michelle Le, REHS, performed an inspection on this facility. At <br />the time of inspection, this facility was given a report stating they must perform <br />secondary containment test by December 31, 2002. <br />2. On September 30, 2002, notification letters were mailed to the facility and owner stating <br />secondary containment testing must be completed by January 1, 2003. <br />3. On November 15, 2002 a certified letter was mailed to the facility stating it was their <br />finally notification to perform secondary containment testing by January 1, 2003. <br />4. CUPA newsletters have been mailed to the facility stating the secondary containment test <br />deadline. (Attachment 4) <br />5. On January 14, 2003, Steven Shih, REHS, took photo on this facility showing this facility <br />is still in operation. (Attachment 5) <br />6. On February 24, 2003, a letter was mailed to the facility stating annual monitoring' <br />certification and line leak detector certification must be performed by March 25, 2003, <br />and the result must be submitted to this office by April 25, <br />7. 2003.
