i <br />I on or before June 1, 2008 <br />2 b. SEVEN THOUSAND DOLLARS ($7,000.00), on or before June 1, 2009 <br />3 8. Defendant shall additionally pay to plaintiff the sum of THREE THOUSAND FOUR <br />4 HUNDRED DOLLARS ($3,400.00) as partial recovery of the cost of investigation and suit <br />5 incurred by the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT. <br />6 Said payment shall be due and pa able to the aforementioned agency, and shall be delivered to <br />7 the San Joaquin County Office of the District Attorney, Environmental Prosecutions Unit, on or <br />8 before JUNE 1, 2007. <br />9 9. Defendant shall additionally pay to plaintiff the sum of THREE THOUSAND TWO <br />10 HUNDRED DOLLARS ($3,200.00) as partial recovery of the cost of investigation and suit <br />11 incurred by the San Joaquin County Office of the District Attorney. Said payment shall be due <br />12 and payable to the aforementioned agency, and shall be delivered to the San Joaquin County <br />13 Office of the District Attorney, Environmental Prosecutions Unit, on or before JUNE 1,2007. <br />14 10. Defendant shall be penalized TWENTY-ONE THOUSAND DOLLARS <br />15 ($21,000.00), as and for civil penalties pursuant to Business and Professions Code sections <br />16 17200 et seq.. However, it is stipulated by all parties that the entire TWENTY-ONE <br />17 THOUSAND DOLLARS ($21,000.00) in civil penalties shall be stayed for five (5) years on the <br />18 condition that the following terms are met: <br />19 a. Defendant will not violate Health and Safety Code sections 25280 et seq., as described <br />20 in paragraph 3 above; <br />21 b. Defendant will not violate Health and Safety Code sections 25100 et seq., as described <br />22 in paragraph 4 above; <br />23 c. Defendant will not violate or engage in any of the unlawful acts of unfair competition <br />24 as set forth in the First and Second Causes of Action of the complaint filed in this action, as well <br />25 as any other violations of the Business and Professions Code sections 17200 et seq., including <br />26 but not limited to Health and Safety Code sections 25280 et seq., and 25100 et seq.. <br />27 11. The TWENTY-ONE THOUSAND DOLLARS ($21,000.00) in civil penalties, <br />28 described in paragraph 12 above, shall immediately be due and payable if the San Joaquin <br />4 <br />PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
