I activities, are pursuant to Health and Safety Code section 25100 et seq., hereby permanently <br />2 enjoined from: <br />3 a. Failing to properly label containers of hazardous waste, in violation of <br />4 California Code of Regulations, title 22, section 66262.34; <br />5 b. Failing to keep a copy of each signed manifest for three (3) years, or until the <br />6 generator receives a signed copy from the designated facility which received the waste, in <br />7 violation of California Code of Regulations, title 22, section 66262.40(a). <br />8 5. Defendants, in the course of defendants' GASOLINE SALES/MINI-MART activities, <br />9 are pursuant to Business and Professions Code § 17204 hereby permanently enjoined from: <br />10 a. Violation of Health and Safety Code section 25280 et seq. described in <br />11 paragraph 3 above; <br />12 b. Violation of Health and Safety Code section 25100 et seq. described in <br />13 paragraph 4 above. <br />14 6. Defendants shall pay to plaintiff the sum of TEN THOUSAND FIVE HUNDRED <br />15 DOLLARS ($10,500.00), as and for civil penalties, pursuant to Business and Professions Code <br />16 section 17206. Said payments shall be made 12ayable to the TREASURER OF SAN JOAQUIN <br />17 COUNTY and delivered to the San Joaquin County Office of the District Attorney, <br />18 Environmental Prosecutions Unit, as follows: <br />19 a. THREE THOUSAND FIVE HUNDRED DOLLARS ($3,500.00), <br />20 on or before June 1, 2008 <br />21 b. SEVEN THOUSAND DOLLARS ($7,000:00), on or before June 1, 2009 <br />22 7. Defendants shall pay to plaintiff the sum of TEN THOUSAND FIVE HUNDRED <br />23 DOLLARS ($10,500.00), as and for civil penalties, pursuant to Health and Safety Code §25299. <br />24 Said payment shall be made payable to the SAN JOAQUIN COUNTY ENVIRONMENTAL <br />25 HEALTH DEPARTMENT - ENVIRONMENTAL HEALTH DIVISION TRUST. Said <br />26 payments shall be delivered to the San Joaquin County Office of the District Attorney, <br />27 Environmental Prosecutions Unit, as follows: <br />28 a. THREE THOUSAND FIVE HUNDRED DOLLARS ($3,500.00), <br />3 <br />PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
