Defendant with actual or constructive knowledge of this Injunction, only in so far as they <br /> 2 are doing business in the State of California, in the course of Defendant's SERVICE STATION <br /> 3 activities, are pursuant to Health and Safety Code section 25 100 et seq., hereby permanently enjoined <br /> 4 from: <br /> 5 a. Disposed or caused the disposal of hazardous waste at a facility not permitted or at <br /> 6 a point which is not authorized, in violation of Health and Safety Code section 25189.5(a); <br /> 7 b. Failed to determine if that waste is a hazardous waste, in violation of California <br /> 8 Code of Regulations,title 22 section 66262.11; <br /> 9 c. Managed a hazardous waste without an EPA ID number, in violation of California <br /> 10 Code of Regulations, title 22 section 66262.12(a); <br /> 11 d. Failed to maintain modified emergency coordinator information, in violation of <br /> 12 California Code of Regulations, title 22 section 66262.34(4)(2); <br /> 13 e. Failed to properly label or mark containers used for onsite accumulation of <br /> 14 hazardous waste,in violation of California Code of Regulations,title 22 section 66262.34(0; <br /> 15 4. Defendant with actual or constructive knowledge of this Injunction,only in so far as they <br /> 16 are doing business in the State of California, in the course of Defendant's SERVICE STATION <br /> 17 activities, are pursuant to Health and Safety Code section 25280 et seq.,hereby permanently enjoined <br /> 18 from: <br /> 19 a. Failed to annually test the spill containment structure, in violation of Health and <br /> 20 Safety Code section 25284.2; <br /> 21 b. Failed to prevent structural weakening of secondary containment, in violation of <br /> 22 Health and Safety Code section 25291(a)(2); <br /> 23 c. Failed to maintain monitoring system for water intrusion and for removing the <br /> 24 water, in violation Health and Safety Code section 25291(e); <br /> 25 d. Failed to maintain evidence of financial responsibility, in violation of Health and <br /> 26 Safety Code section 25292.2(a); <br /> 27 e. Failed to install and maintain monitoring equipment capable of detecting a leak at <br /> 28 the earliest possible opportunity, in violation of California Code of Regulations,title 23 section <br /> 2 <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT <br />
