Failed to meet spill container requirements to prevent hazardous substance from <br /> 5 entering the subsurface environment, in violation of California Code of Regulations, title 23 section <br /> 6 2635(b)(1); <br /> 7 h. Failed to maintain proper overfill prevention system,in violation of California <br /> 8 Code of Regulations, title 23 section 2635(b)(2); <br /> 9 i. Failed to perform timely secondary containment tests, in violation of California <br /> 10 Code of Regulations,title 23 section 2637(a); <br /> I I j. Failed to perform annual certification of monitoring equipment, in violation of <br /> 12 California Code of Regulations,title 23 section 2638(a); <br /> 13 k. Failed to retain a copy of the permit and all conditions and attachments,including <br /> 14 monitoring plans at the facility, in violation of California Code of Regulations,title 23 section <br /> 15 2712(i); <br /> 16 1. Failed to maintain a proper list of facility employees trained by the designated <br /> 17 underground storage tank operator on-site, in violation California Code of Regulations, title 23 <br /> 18 section 2715(f)(3); and <br /> 19 5. Defendant with actual or constructive knowledge of this Injunction,only in so far as they <br /> 20 are doing business in the State of California, in the course of Defendant's SERVICE STATION <br /> 21 activities, are pursuant to Business and Professions Code § 17204 hereby permanently enjoined from: <br /> 22 a. Violation of Health and Safety Code section 25 100 et seq. described in paragraph <br /> 23 3 - 3e above. <br /> 24 b. Violation of Health and Safety Code section 25280 et seq. described in paragraph <br /> 25 4 -41 above; <br /> 26 6. Defendants shall pay to Plaintiff the sum of SEVENTEEN THOUSAND TWO <br /> 27 HUNDRED FIFTY DOLLARS ($17,250.00), as and for civil penalties,pursuant to Business and <br /> 28 Professions Code section 17206. Said payments shall be made payable to the TREASURER OF <br /> 3 <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT <br />
