The 91 fill sump sensor was raised off the bottom of sump and observed tied to the top of the sump collar, and was not located to detect a leak at the earliest opportunity. Several inches of liquid was observed at the bottom of the 91 fill sump; the sensor was located several inches above the liquid. The most recent 91 fill sump alarm was on March 22, 2016. Mr. Hur initially stated that there was no liquid in the 91 fill sump on 3/22/16 and that the fuel alarm was caused by a small amount of condensation on the outside of the 208 sensor, which he wiped off with a towel. The designated operator on site during the inspection stated that Mr. Hur had told him in April 2016 that the sump had been "cleaned out and put water in the waste drum", which had been documented on the April 2016 monthly inspection report. Mr. Hur then stated that he had found liquid inside the 91 fill sump, but that it was fuel, not water, inside the sump at that time, and that he pumped the liquid out of the sump and placed it in the waste drum behind the store. Monitoring equipment shall be maintained to be able to detect a leak at the earliest possible opportunity. The sensor was relocated by the technician at the time of inspection. This is a Class I violation. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by January 28, 2017. Please be aware that as of January 1, 2014, facility operators are required to upload the following UST program documents into the California Environmental Reporting System (CERS): UST Monitoring Site Plan, UST Certification of Financial Responsibility, UST Response Plan, UST Letter from Chief Financial Officer (if applicable), and the Owner Statement of Designated Operator Compliance. The UST Owner/Operator: Written Agreement, if applicable, can be stored at the facility or uploaded into CERS. Documents reviewed: CERS submittals, maintenance records / work orders, test results, designated operator monthly inspection reports, designated operator training records Documents provided: Return to Compliance Certification form, Schedule of free CUPA classes AFTER THE COMPLIANCE DATE, EHD WILL BILL FOR ALL TIME AND ACTIVITIES ASSOCIATED WITH BRINGING THIS FACILITY BACK INTO COMPLIANCE.
