S0 JOA U 1 Environmental Health Department
U ; i y
Small Quantity Hazardous Waste Generator Inspection Report
Facility Name: Facility Address: Date:
Staples the Office Superstore#1341 249 COMMERCE AVE, MANTECA June 03, 2020
SUMMARY OF VIOLATIONS
(CLASS I,CLASS II,or MINOR-Notice to Comply)
Item# Remarks
103 CCR 66262.40(c) Failed to retain hazardous waste determination including waste analysis on site for 3 years.
OBSERVATION:A bagged bottle of spilled black paint, or water-based paint according to Rick Cormier, the store
manager, was observed without a product label and was found inside a container labeled as a Hazardous Waste
Oxidizer. However, it could not be determined why the paint was determined to be an oxidizer versus another
hazardous waste category, such as state regulated/toxic, corrosive base, flammable, etc. Rick reviewed the
StrongPak Guide to Potentially Hazardous Materials Management and stated the manager who placed the paint in
the oxidizer hazardous waste container must have thought the paint did not belong in any of the other hazardous
waste categories.
The business operator does not have hazardous waste determination records that support the current handling
and disposal of the paint waste.
REGULATION GUIDANCE:A business operator shall keep records of any hazardous waste determinations made
in accordance with Title 22 California Code of Regulations(CCR)section 66262.11 for at least three years from the
date that the waste was last sent to an on-site or off-site treatment, storage, or disposal facility. The records may
include Safety Data Sheets(SDS), waste test results or other hazardous waste determination documentation.
CORRECTIVE ACTION: Assemble the hazardous waste determination documentation for the paint/water-based
paint waste, maintain on site and submit a copy to the San Joaquin County Environmental Health Department
(EHD).
If hazardous waste determination documentation is not available, immediately make a hazardous waste
determination and begin managing the paint/water-based paint waste as specified in Title 22 CCR. Use Safety
Data Sheets(SDS),waste sampling and test results or other knowledge to support your hazardous waste
determination. Waste testing must be done using methods specified in Title 22 CCR including sections
66261.20-24. Submit a statement and supporting documentation with your hazardous waste determination.
Demonstrate current storage and labeling for wastes determined to be hazardous wastes. Provide disposal
records for wastes determined to be hazardous wastes and stored longer than the number of days specified in Title
22 CCR for your hazardous waste generator status.
This is a minor violation.
FA0014573 PR0540367 SCO01 06/03/2020
EHD 22-01 Rev.9/20/2019 Page 4 of 6 Small Quantity Hazardous Waste Generator OIR
1868 E.
