Item No. _ 3 <br /> B/A 1-8-81 <br /> U-81-37 <br /> Page 2 <br /> REFERRALS AND REPLIES <br /> - Building Department -- No comment . <br /> - Public Works Department -- "Information: The site would not be subject to <br /> flooding from an Intermediate Regional Flood. Bruella Road at this site, <br /> has an existing right of way width of 40 feet, and a planned right of way <br /> width of 60 feet . Road right of way dedication will not be required. <br /> Application is to legalize drain pond which has existed for ten years - does <br /> not encroach roadway. Recommendations : None. " <br /> - Flood Control <br /> - Air Pollution Control District <br /> - Local Health District -- "In the event that this Application is approved, it <br /> is requested that the following conditions be made a part of the approval. <br /> 1. Obtain discharge requirements from the Regional Water Quality Control <br /> Board, Central Valley Region. Provide minimum five (5) foot high perimeter <br /> fencing around the ponds with a locked gate. 2 . All brine to be disposed <br /> of in the waste water settling pond shall first be oxidized in process <br /> equipment which facilitates either chemical or catalytic air oxidation of <br /> the calcium sulfite and calcium bisulfite to calcium sulfate before being <br /> transferred into the pond. An Authority to Construct approving the equip- <br /> ment to be installed to affect the oxidation must be obtained from the Air <br /> Pollution Control District before construction of such equipment commences . <br /> As an alternative to the oxidation process, Tenneco West may process the <br /> waste brine by removing all organic matter and other contaminants and recycle <br /> the reclaimed brine, thereby eliminating the need for the pond. <br /> - Pacific Telephone and Telegraph Company <br /> - Pacific Gas & Electric Company <br /> - Mokelumne Fire District <br /> - Regional Water Quality Control Board, Central valley Region -- A Waste <br /> Discharge Report must be filed. <br /> OTHER CONSIDERATIONS <br /> - The Environmental Review Officer determined that this application may be <br /> processed under a Negative Declaration. The Initial Study is on file in the <br /> Planning Department. <br /> - Proposal is to legalize a pond which was constructed approximately 10 years <br /> ago by the previous owners . <br /> - The most noticeable aspect of the project are odors emitting from the pond <br /> which is clearly evident from Bruella Road to the east . <br /> - The pond is not fenced, which if approved, should be made a condition. <br /> - The pond area was illegally divided and it will be necessary to file a Parcel <br /> Map to correct. Another solution would be to combine the parcels, as they <br /> are both under the same ownership. <br /> - The application was made as a result of enforcement action. <br /> - It appears that some of the existing plant storage area is located outside <br /> the M-1 Zone. Consideration should be given to requiring the applicant to <br /> rezoning the entire plant property EA/AP Zone. This would legalize the <br /> use, as well as permit future expansion. <br />
