At this time, there is no justification for Paradise Avenue to be classified as a Minor Arterial. However, in <br /> the attached letter of January 23, 1996, the City of Tracy states: <br /> The City of Tracy is currently processing an annexation for industrial property south and west of <br /> this site. The traffic study for this project's EIR is not yet complete. However, preliminary <br /> indications are that Paradise Road north of 1-205 to Arbor Avenue may eventually be designated <br /> as an arterial street with a right-or-way of up to 100 feet or more. This information may be <br /> beneficial to those who are designing on-site improvements and their proximity to Paradise Road. <br /> Appeal Statement No. 4 <br /> Initial Plan submission: this requirement was not indicated. <br /> Response to Appeal Statement No. 4 <br /> Because this issue was not addressed before the application was submitted, the applicant was offered <br /> a full refund. The applicant chose instead to proceed with the understanding that staff would deny the <br /> application, at which time he could appeal staff's action to the Planning Commission. <br /> Additional Appeal Statements <br /> • Paradise can be accessed by three very close major roads: <br /> A. 205 & MacArther to Arbor and Pescadero. <br /> B. Grant line to Paradise. <br /> • Many existing similar businesses are located in County on smaller paved roads. List can be <br /> provided. <br /> • City of Tracy letter indicates possible future designation of Paradise as a Minor Arterial. <br /> • West Lathrop Specific Plan indicated Paradise as intersection of 205 and Minor Arterial. <br /> • Our agriculture use will have a very minimal use, and the Minor Arterial requirements of 4 lanes <br /> and 25,000 vehicles does not seem appropriate. <br /> • Agriculture and small businesses are needed; our use is approved per Section 9-115.435, with <br /> the exception of this minor technicality. <br /> Response to Additional Appeal Statements <br /> Staff does not take issue with the above statements.
