Appeal Statement No. 1 <br /> In his appeal, Mr. Remitz made the following statement: <br /> Property is next to Highway 205 which is a freeway. <br /> Response to Appeal Statement No. 1 <br /> Section 9-605.5(h)(2) states: <br /> The use type shall only be established on a road designated on the General Plan as a Minor <br /> Arterial or higher classification of roadway. <br /> Staff interprets the above language to mean that the use shall have access on a road designated on the <br /> General Plan as a Minor Arterial or higher classification of roadway. The issue is one of access, not of <br /> visibility. <br /> Appeal Statement No. 2 <br /> In his appeal, Mr. Remitz made the following statement: <br /> Pavement width at existing paved entrance drive is 32 feet and Paradise is 100 feet wide per <br /> County map. <br /> Response to Appeal Statement No. 2 <br /> Public Works' records indicate that the pavement width is 23 feet. However, there is a paved shoulder <br /> of approximately 5 feet on either side of Paradise Avenue at the site entrance. That shoulder narrows to <br /> zero feet at the north end of the property. <br /> Due in part to the change in grade for the overpass, Paradise Avenue has a 100-foot right-of-way at this <br /> site. There are no plans to widen the roadway pavement width. However, the City of Tracy has indicated <br /> that future annexations and developments may lead to the reclassification and widening of Paradise <br /> Avenue (see attached letter). <br /> Appeal Statement No. 3 <br /> In his appeal, Mr. Remitz made the following statement: <br /> Paradise a 100 foot wide road, needs to be changed to a Minor Arterial between Arbor and Grant <br /> Line on City Map as it carries local through traffic per Section IV-1.1.d. <br /> Response to Appeal Statement No. 3 <br /> General Plan Roadway Policy 1.(d) states: <br /> Minor Arterial, designated as a secondary type of facility carrying local through traffic to areas <br /> similar to those served by Major Arterials and feeding the Major Arterial.
