Analysis
Cellular facilities may be conditionally permitted in the R-M zone with an approved Use Permit. As of
March 20, 1996, no letters in opposition have been received.
Land Use/Screening/Landscaping
The adjacent property to the west, north, and east is vacant and zoned for residential use. The properties
to the south across Oak Street are developed with residences. Ordinarily, staff would recommend
screening and landscaping for a discretionary commercial use adjacent to residential properties.
However, because the existing structure was approved without screening or landscaping, staff has
determined that there is not an adequate nexus to require screening or landscaping for the proposed
pole. No other issues have been identified.
Recommendations
Action
It is recommended that the Planning Commission:
1. Approve the Negative Declaration; and
2. Approve Use Permit No. UP-96-1 with the findings and Conditions of Approval contained In
the staff report.
Findings
1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan,
any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable
plan adopted by the County.
• This finding can be made because cellular facilities may be conditionally permitted
in the R-M zone with an approved Use Permit. No other plans apply.
2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary
facilities have been provided, and the proposed improvements are properly related to existing and
proposed roadways.
• This finding can be made because the site has frontage on Oak Street. No water or
sewage disposal facilities are needed because the facility does not require personnel.
Drainage can be retained on the site at the north end of the property. The proposed
monopole will not increase the amount of drainage required because it will be located
where the surface is already impervious.
San Joaquin County UP-96-1/Pacific Bell
Community Development Page 5
