e still no closer towards getting
and what appears to be a bungled site clean-up we ohat Unocalas a
saleable, fully mitigated property;notwithstanding your vague statements
"good corporate citizen" and how your company will provide" compelling documentation
of the completeness of the remediation"!..
I would appreciate your advising me when you expect to complete the latest site re-
evaluation. As I understand it, your geologist,Mittlehauser Corp. has already had (2) two
weeks advance notice as to what is required of them by SJCPHS. You are once again
reminded that you have failed to secure soils and groundwater closure, and accordingly
have an ongoing, contractural obligation for lease rental payment until this site is fully
mitigated and signed off by all governing bodies, having jurisdiction over this matter.
Regarding the relocation of MW.=3A,Mr. Knoll is emphatic that this well remain where it
is, in order for it to function as a reliable data collection point. This fact, plus the now-
mandated "new construction" borings/excavations, etc., associated with this latest site
evaluation, is but further evidence of just how incomplete your mitigation really is!
Once again, I must remind you that our business is far from over: You arei arrears haon
rental payments and property taxes from October to present date and future.
also failed to adequately address the site utilities stub-out map and city of Tracy sign-offs,
as requested in my previous letters. T
Mr. Senner, you have much to do and the time you have to comply with your lease
r obligations is becoming as short as my patience.....
Si cerely,
Kathle n Gayner Deutsch
For the Gayner Family Partnership
c.c.s.:
Mr. Edward Ralston
Unocal Corporation,
Mr. Harlin Knoll Ms. Lori Casias
SJCPHS.
