<br /> AN ORDINANCE AMENDING TITLE 9 OF THE ORDINANCE CODE OF THE COUNTY
<br /> OF SAN JOAQUIN, RELATIVE TO SECTIONS 9-1102 (c) ( 1 ) , 9-3083 . 093 ,
<br /> 9-3083 . 095 , 9-3083 . 097 , 9-3233 , 9-4013 , 9-4110 , 9-4209 , 9-5011 ,
<br /> 9-5109 , 9-5139 , 9-5169 , 9-5209 , 9-5259 , 9-5309 , 9-5409 , 9-5509 ,
<br /> 9-5609 ; CONCERNING DEFINITIONS FOR FENCES , SPECIAL FENCE REQUIREMENTS ,
<br /> AND FENCE REGULATIONS FOR THE EA, GA, I-PA, RR, RA, R1 , R2 , R3 , AND R4
<br /> ZONES .
<br /> SECTION Section 9-3083 . 093 , Chapter 2 , Division 3 , Title
<br /> 9 , of the San Joaquin County Ordinance Code is hereby added to read as
<br /> follows :
<br /> SECTION 9-3083 . 093 . FENCE . "Fence" means a wall or barrier
<br /> Lpuaer,-t-ed 0 boards , masonry, wire , or any other material for the
<br /> purpose of enclosing space or separating parcels of land. The
<br /> term "fence" does not include retaining walls, but does include
<br /> fenceag tes and gateposts .
<br /> SECTION Section 9-3083 . 095 , Chapter 2 , Division 3 , Title
<br /> 9 , of the San Joaquin County Ordinance Code is hereby added to read as
<br /> follows:
<br /> SECTION 9-3083 . 095 . FENCE HEIGHT. "Fence height" means that
<br /> the height of any fence shall be determined 12y measurement from
<br /> the natural or finished grade at the lowest side of the fence . If
<br /> a fence is proposed to be built on top of an earthern berm or
<br /> other landscape feature , the maximum fence height shall include
<br /> the height of the berm or landscape feature .
<br /> SECTION Section 9-3083 . 097 , Chapter 2 , Division 3 , Title
<br /> 9 , of the San Joaquin County Ordinance Code is hereby added to read as
<br /> follows :
<br /> SECTION 9-3083 . 097 . FENCE, OPEN. "Open fence" means the
<br /> same as "fence" except that materials used in the construction of
<br /> the fence shall afford a clear view between the road or adjoining
<br /> properties and the property that is fenced. Materials used to
<br /> build an open fence may include wire , wood rails, chain link, and
<br /> wrought iron.
<br /> SECTION Section 9-3233 , Chapter 4 , Division 3 , Title 9 ,
<br /> of the San Joaquin County Ordinance Code is hereby amended by adding
<br /> Subsections (a) through ( f) to read as follows :
<br /> SECTION 9-3233 . SPECIAL FENCE REQUIREMENTS AND CLEAR VIEW OF
<br /> INTERSECTING STREETS .
<br /> (a) Noise Attenuation Walls . Walls , fences , berms, and or
<br /> landscaping for the purpose of noise attenuation may be
<br /> required in any zone when adjacent to a high noise generator
<br /> such as a major roadway or railroad Noise attenuation
<br /> requirements will be developed in response to the noise level
<br /> and source affecting specific property . Height and yard
