Section 9-315.7, Chapter 9-315, Division 3, Title 9, of the San Joaquin County <br /> Ordinance Code is hereby amended by amending subsection (b) to read as follows: <br /> Section 9-315.7 Guarantees for Continued Affordability. <br /> (b) The developer shall SigA a DOV919PRIORt enter into an Agreement with San Joaquin <br /> County to ensure compliance with the provisions of this section. <br /> SECTION 9. Section 9-405.5 is hereby added to Chapter 9-405, Division 4, Title 9, of the San <br /> Joaquin County Ordinance Code to read as follows: <br /> Section 9-405.5 Special Use Regulations in Commercial Zones. In addition to the provisions of <br /> Sections 9-405.2 through 9-405.4, the following regulations shall apply to Commercial Zones: <br /> (a) Unless the use type is more restrictive, a Site Approval (Section 9-818) is required for any <br /> commercial use that is: <br /> M Six thousand (6000) feet or greater in ground floor area; <br /> Occupies ten (10) or more acres of site area; or <br /> fgl Not served by a public wastewater treatment plant, public water system, and a <br /> public drainage system; <br /> Outside displays or storage shall require a Site Approval, unless the review method for <br /> the use type is more restrictive. <br /> (c) Any change in an existing commercial use to a new commercial use which requires either <br /> a Site Approval or an Improvement Plan shall be permitted without a Site Approval or <br /> Improvement Plan, provided the Review Authority finds that the proposed use is less <br /> detrimental to, or will have no greater impact in, the zone than the existing use. <br /> SECTION 10. Table 9-405.2, Chapter 9-405, Division 4, Title 9, of the San Joaquin County <br /> Ordinance Code is hereby amended by amending the Table Note to read as follows: <br /> Table 9-405.2: Uses in Commercial Zones <br /> Note: <br /> -10- <br />
