PC : 3-17-88 <br /> TA-88-7 <br /> STAFF ANALYSIS <br /> BACKGROUND : <br /> Under the existing ordinance , legislative actions such as General <br /> Plan Amendments and Zone Reclassifications cannot be conditioned <br /> to assure that property will develop with certain uses or at a <br /> specified density or intensity of use . The proposed Text <br /> Amendment would allow a Development Agreement to be entered into <br /> by the County. When processed concurrently with a General Plan <br /> Amendment or a Zone Reclassification, a Development Agreement <br /> could be used to restrict future uses of the property. <br /> The need for this Text Amendment authorizing Development <br /> Agreements was brought out by the Cooper General Plan Amendment <br /> (GP-88-12 ) . The Cooper General Plan Amendment concerns a request <br /> to change the General Plan map designation for property adjacent <br /> to the Stockton Metropolitan Airport from Agriculture to General <br /> Industrial . The underlying project involves the use of 10 acres , <br /> of the 75 acres proposed for the General Plan map change, for a <br /> jet engine repair facility. The applicant has stated his <br /> willingness to enter into a Development Agreement with the County <br /> that will commit the balance of his property to airport-related <br /> uses. However , since the County does not have a Development <br /> Agreement ordinance, no such restrictions on the future uses of <br /> the applicant ' s property can be imposed. <br /> CHARACTERISTICS OF A DEVELOPMENT AGREEMENT : <br /> A Development Agreement does not take the place of any of the <br /> existing land use approval requirements . It is a supplement to <br /> them. Under a Development Agreement , both the County and the <br /> developer commit themselves to proceed in accordance with the <br /> terms of the Agreement . As a consequence of the Agreement , the <br /> County promises not to change its planning or zoning laws appli- <br /> cable to the subject development for a specified period of time . <br /> In effect , future land use decisions are made according to the <br /> rules, regulations , and policies in effect at the time the <br /> Agreement was entered into . In return, the developer agrees to <br /> commit his property to specific uses , construct specific improve- <br /> ments, provide certain facilities and services , develop according <br /> to a specific time schedule , or make other commitments that the <br /> County might otherwise have no authority to compel a developer to <br /> perform. <br /> TEXT AMENDMENT, MAJOR PROVISIONS : <br /> The proposed Development Agreement Ordinance would contain the <br /> following major provisions : <br /> -3- <br />
