PC : 3-17-88
TA-88-7
STAFF ANALYSIS
BACKGROUND :
Under the existing ordinance , legislative actions such as General
Plan Amendments and Zone Reclassifications cannot be conditioned
to assure that property will develop with certain uses or at a
specified density or intensity of use . The proposed Text
Amendment would allow a Development Agreement to be entered into
by the County. When processed concurrently with a General Plan
Amendment or a Zone Reclassification, a Development Agreement
could be used to restrict future uses of the property.
The need for this Text Amendment authorizing Development
Agreements was brought out by the Cooper General Plan Amendment
(GP-88-12 ) . The Cooper General Plan Amendment concerns a request
to change the General Plan map designation for property adjacent
to the Stockton Metropolitan Airport from Agriculture to General
Industrial . The underlying project involves the use of 10 acres ,
of the 75 acres proposed for the General Plan map change, for a
jet engine repair facility. The applicant has stated his
willingness to enter into a Development Agreement with the County
that will commit the balance of his property to airport-related
uses. However , since the County does not have a Development
Agreement ordinance, no such restrictions on the future uses of
the applicant ' s property can be imposed.
CHARACTERISTICS OF A DEVELOPMENT AGREEMENT :
A Development Agreement does not take the place of any of the
existing land use approval requirements . It is a supplement to
them. Under a Development Agreement , both the County and the
developer commit themselves to proceed in accordance with the
terms of the Agreement . As a consequence of the Agreement , the
County promises not to change its planning or zoning laws appli-
cable to the subject development for a specified period of time .
In effect , future land use decisions are made according to the
rules, regulations , and policies in effect at the time the
Agreement was entered into . In return, the developer agrees to
commit his property to specific uses , construct specific improve-
ments, provide certain facilities and services , develop according
to a specific time schedule , or make other commitments that the
County might otherwise have no authority to compel a developer to
perform.
TEXT AMENDMENT, MAJOR PROVISIONS :
The proposed Development Agreement Ordinance would contain the
following major provisions :
-3-
