PC: 6-2-88
TA-88-10
that 10-acre zoning would be allowable for property under
contract . The suggested change would recognize this decision
of the Board. In addition, it would allow property carrying
the proposed Limited Agricultural zoning classification (AL-5
or AL-10) to remain under contract .
2 . Require the County to file a Notice of Nonrenewal on any par-
cel under contract less than five acres in size that contains
a residence.
Commment : This provision is intended to codify into the
Planning Title Board Order B-84-163 , which requires the
County to issue a Notice of Nonrenewal on any parcel under
contract that is less than five acres in size and that con-
tains a principal residence .
3 . Relocate the section dealing with historical structures and
archaeological sites from the chapter on the GA zone to the
chapter titled "Supplementary and Qualifying Regulations. "
Comment : The existing chapter on the GA zone contains provi-
sions concerning historical structures, landmarks, and
archaeological sites. Because this chapter will be replaced
by the Intent section of the proposed agricultural zones, the
portion of the chapter dealing with historical structures
needs to be relocated to some other area of the Planning
Title. Staff recommends that these provisions be relocated
to the chapter on Supplementary and Qualifying Regulations,
since they could apply to historical structures, landmarks,
and archaeological sites located in any zone.
4. Allow tentative map extensions for a period of up to three
years.
Comment : This change was necessary in order to bring the
Planning Title into conformity with State Law.
ENVIRONMENTAL CONSIDERATIONS :
The Initial Study prepared for TA-88-10 on May 16, 1988, found
that the Text Amendment would not have a significant impact on
the environment . Based on the Initial Study, a Negative
Declaration has been prepared.
-4-
