ORDINANCE NO. <br /> AN ORDINANCE AMENDING TITLE 9 OF THE ORDINANCE CODE OF THE COUNTY <br /> OF SAN JOAQUIN, RELATIVE TO SECTIONS 9-1024, 9-2341 , 9-2352 , 9-3247 , <br /> 9-3552 , 9-4113 , 9-9134, AND 9-9184, CONCERNING ENFORCEMENT PROCEDURES ; <br /> ZONING REQUIREMENTS FOR AGRICULTURAL PRESERVES; NOTICES OF NONRENEWAL; <br /> HISTORIC STRUCTURES; NONCONFORMING BUILDINGS ; AND EXTENSIONS OF <br /> APPROVED TENTATIVE MAPS . <br /> SECTION 1 Section 9-1024, Chapter 2 , Division 1 , Title 9, <br /> of the San Joaquin County Ordinance Code is hereby amended by <br /> amending Subsection (d) , to read as follows: <br /> (d) Action by District Attorney. Notwithstanding Subsections (a) <br /> through tort (c) , the District Attorney may immediately com- <br /> mence action for abatement and/or removal of a public <br /> nuisance in the manner provided by law, and shall take other <br /> steps and apply to such court as may have jurisdiction to <br /> grant such relief . <br /> SECTION 2 Section 9-2341 , Chapter 18, Division 3 , Title 9, <br /> of the San Joaquin County Ordinance Code is hereby amended to read as <br /> follows: <br /> SECTION 9-2341 . REQUIREMENTS FOR APPLICATION. Agricultural <br /> Preserve applications may be initiated by the Board of <br /> Supervisors, Planning Commission, Director of Planning and <br /> Building Inspection, the property owner or his designated agent . <br /> Applications shall be filed with the Planning Division. <br /> Agricultural Preserve applications which request the establishment <br /> or alteration of an agricultural preserve shall be subject to the <br /> following additional requirements : <br /> (a) Minimum Size. The minimum size necessary for the establish- <br /> ment or resulting alteration of an agricultural preserve <br /> shall be one hundred ( 100) acres of contiguous land; <br /> (b) Zoning. All prime land for which agricultural preserve sta- <br /> tus is being sought , or which is currently in an agricultural <br /> preserve, shall be zoned for to an agricultural zone classi- <br /> fication; <br /> acTres; <br /> (c) Zoning Classification. If the subject property(s) does not <br /> have the required zoning, an application for Zone <br /> Reclassification shall be made and processed concurrently <br /> with the Agricultural Preserve application. However, such <br /> Zone Reclassification application shall be approved prior to <br /> establishing or altering an agricultural preserve . <br /> SECTION 3 Section 9-2352 , Chapter 19, Division 2, Title 9, <br /> of the San Joaquin County Ordinance Code is hereby amended by amending <br /> Subsection (b) to read as follows: <br /> TA-88-10 (5th Draft ) - 1 - ( 5-23-88) <br />
