(b) Nonrenewal . If the owner or the County desires not to renew <br /> the contract , they shall serve a written Notice of Nonrenewal <br /> of the contract on the other party pursuant to Section <br /> 9-2353(a) . A written Notice of Nonrenewal must be served in <br /> the following situations : <br /> ( 1 ) If there are less than twenty ( 20) contiguous acres <br /> under contract , the County shall serve a Notice of <br /> Nonrenewal on the owners of all affected properties ; <br /> (2) If the property under contract is less than five (5) <br /> acres in size and contains a residence, the County shall <br /> serve a Notice of Nonrenewal on the owners of said pro- <br /> perty; <br /> (3) t2} If property under contract is being divided, the owner <br /> of the property shall serve a Notice of Nonrenewal on <br /> the County for any resulting parcels less than ten ( 10) <br /> acres in size in the case of prime agricultural land, or <br /> less than forth (40) acres in size in the case of land <br /> which is not prime, prior to obtaining map approval ; <br /> (4) t-at If any property under contract is removed from an agri- <br /> cultural preserve by either a change in the boundaries <br /> of the preserve or disestablishment of the preserve, the <br /> County shall serve a Notice of Nonrenewal on the owner <br /> of the subject property; <br /> LZ t4t If any property under contract is reclassified to a <br /> zone other than that required for an agricultural pre- <br /> serve, the County shall serve a Notice of Nonrenewal on <br /> the owner of the subject property; <br /> SECTION 4 Section 9-3247 is hereby added to Chapter 4, <br /> Division 3 , Title 9, of the San Joaquin County Ordinance Code to read <br /> as follows : <br /> SECTION 9-3247 . HISTORICAL STRUCTURES, LANDMARKS, OR <br /> ARCHAEOLOGICAL SITES . Upon the securing of a Use Permit , alter- <br /> native uses, not otherwise enumerated as permitted or conditional <br /> uses in this Title, m_y be permitted for historical structures, <br /> landmarks, or archaeological sites to provide the means or incen- <br /> tives for private owners to maintain, rehabilitate, restore, <br /> and/or preserve such historical resources as a record of the <br /> social , economic, and political history of the County for the <br /> appreciation, benefit , education, and enToyment of future genera- <br /> tions, subject to the following conditions : <br /> (a) Such historical structures, landmarks, or archaeological <br /> sites shall qualify as such if identified as being signifi- <br /> cant by a recognized historical or architectural organiza- <br /> tion, or whose value can be established through presentation <br /> of historical or architectural literature, publications, or <br /> official documents which discuss the structure, landmark, or <br /> site and its place in history; <br /> TA-88-10 (5th Draft) - 2 - ( 5-23-88) <br />
