ORDINANCE NO. AN ORDINANCE AMENDING TITLE 9 OF THE ORDINANCE CODE OF THE COUNTY OF SAN JOAQUIN, RELATIVE TO SECTIONS 9-1024, 9-2341 , 9-2352 , 9-3247 , 9-3552 , 9-4113 , 9-9134, AND 9-9184, CONCERNING ENFORCEMENT PROCEDURES ; ZONING REQUIREMENTS FOR AGRICULTURAL PRESERVES; NOTICES OF NONRENEWAL; HISTORIC STRUCTURES; NONCONFORMING BUILDINGS; AND EXTENSIONS OF APPROVED TENTATIVE MAPS. SECTION Section 9-1024, Chapter 2 , Division 1 , Title 9, of the San Joaquin County Ordinance Code is hereby amended by amending Subsection (d) , to read as follows: (d) Action by District Attorney. Notwithstanding Subsections (a) through tet (c) , the District Attorney may immediately com- mence action for abatement and/or removal of a public nuisance in the manner provided by law, and shall take other steps and apply to such court as may have jurisdiction to grant such relief . SECTION Section 9-2341 , Chapter 18, Division 3 , Title 9, of the San Joaquin County Ordinance Code is hereby amended to read as follows: SECTION 9-2341 . REQUIREMENTS FOR APPLICATION. Agricultural Preserve applications may be initiated by the Board of Supervisors, Planning Commission, Director of Planning and Building Inspection, the property owner or his designated agent . Applications shall be filed with the Planning Division. Agricultural Preserve applications which request the establishment or alteration of an agricultural preserve shall be subject to the following additional requirements: (a) Minimum Size. The minimum size necessary for the establish- ment or resulting alteration of an agricultural preserve shall be one hundred ( 100) acres of contiguous land; (b) Zoning. All viine land for which agricultural preserve sta- tus is being sought , or which is currently in an agricultural preserve, shall be zoned for to an agricultural zone classi- fication; caltarcLi preserve, shm±i be zoned fax agricalta— With 4A acres; (c) Zoning Classification. If the subject property(s) does not have the required zoning, an application for Zone Reclassification shall be made and processed concurrently with the Agricultural Preserve application. However, such Zone Reclassification application shall be approved prior to establishing or altering an agricultural preserve. SECTION Section 9-2352 , Chapter 19, Division 2 , Title 9, of the San Joaquin County Ordinance Code is hereby amended by amending Subsection (b) to read as follows: TA-88-10 ( 2nd Draft) - 1 - (4-11-88)
