(b) Nonrenewal . If the owner or the County desires not to renew the contract, they shall serve_ a written Notice of Nonrenewal of the contract on the other party pursuant to Section 9-2353 (a) . A written Notice of Nonrenewal must be served in the following situations: ( 1 ) If there are less than twenty (20) contiguous acres under contract , or if the property under contract con- tains less than five (5)_ acres, the County shall serve a Notice of Nonrenewal on the owners of all affected pro- perties; (2) If property under contract is being divided, the owner of the property shall serve a Notice of Nonrenewal on the County for any resulting parcels less than ten ( 10) acres in size in the case of prime agricultural land, or less than forth (40) acres in size in the case of land which is not prime, prior to obtaining map approval ; (3) If any property under contract is removed from an agri- cultural preserve by either a change in the boundaries of the preserve or disestablishment of the preserve, the County shall serve a Notice of Nonrenewal on the owner of the subject property; (4) If any property under contract is reclassified to a zone other than that required for an agricultural pre- serve, the County shall serve a Notice of Nonrenewal on the owner of the subject property; SECTION Section 9-3247 is hereby added to Chapter 4, Division 3, Title 9, of the San Joaquin County Ordinance Code to read as follows: SECTION 9-3247 . HISTORICAL STRUCTURES, LANDMARKS, OR ARCHAEOLOGICAL SITES. Upon the securing of a Use Permit, alter- native uses, not otherwise enumerated as permitted or conditional uses in this Title, may be permitted for historical structures, landmarks, or archaeological sites to provide the means or incen- tives for private owners to maintain, rehabilitate, restore, and/or preserve such historical resources as a record of the social, economic, and political history of the County for the appreciation, benefit , education, and enjoyment of future genera- tions, subject to the following conditions: (a) Such historical structures, landmarks, or archaeological sites shall qualify as such if identified as being signifi- cant bV a recognized historical or architectural organiza- tion, or whose value can be established through presentation of historical or architectural literature, publications, or official documents which discuss the structure, landmark, or site and its place in history; (b) No use of such historical structure, landmark, or archaeolo- gical sites shall detract from or otherwise impair such TA-88-10 ( 2nd Draft) - 2 - (4-11-88 )
