TA-93-3: HOMESITE PARCELS <br /> IT IS RECOMMENDED: <br /> That the Board of Supervisors: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Development Title Text Amendment No.TA-93-3 based on the"Bases for Recommenda- <br /> tion" contained in the staff report. <br /> BACKGROUND: <br /> At the Board's direction, the Planning Commission has recommended revisions to the provisions in the <br /> Development Title concerning the creation of homesite parcels in commercial agricultural areas. Under <br /> the existing regulations, homesite parcels may be created in the A-G zone provided General Plan density <br /> is not exceeded. The current provisions provide the opportunity for numerous homesite parcels to be <br /> created from large acreage. At the same time, they preclude the creation of homesite parcels from <br /> parcels which are less than 40 acres in size. The Text Amendment addresses these and other issues by <br /> proposing a number of substantive changes. Briefly, the Text Amendment would: <br /> 1. Permit the creation of not more than four homesite parcels from an existing parcel in the A-G <br /> zone, provided General Plan density (one dwelling unit per 20 acres) is not exceeded. <br /> 2. Discourage speculation by requiring the landowner to: <br /> own the land for five years before being allowed to create a homesite parcel; <br /> hold the homesite parcel for an additional five years after its creation before <br /> selling it; <br /> obtain a building permit for a single family dwelling for each approved homesite <br /> parcel at the time the parcel map for the homesite parcel is recorded. <br /> 3. Allow the creation of two-to-five acre homesite parcels from parcels less than 40 acres in size (or <br /> from parcels of any size in the A-G zone) for financing purposes only, with the following <br /> restrictions: <br /> the homesite parcel cannot be sold separately from the remainder of the farm <br /> (except in the instance of a foreclosure action brought by an institutional lender, <br /> in which case both the homesite parcel and the remainder parcel can be sold <br /> separately); <br /> the homesite parcel and the remainder parcel must be merged back together by <br /> the owner once the loan on the homesite parcel is repaid. <br />
