Dodds Rd. , Escalon) objected to the proposed <br /> ordinance. He said that farmers should be allowed to retain their <br /> homesites. <br /> Al Costa (7511 E. Woodbridge Rd. , Acampo) said he is a farmer and <br /> wants to create a parcel for his daughter. He objected to the <br /> proposed ordinance. <br /> PUBLIC HEARING CLOSED <br /> Chair Carter commented that this Text Amendment is being heard <br /> because therelhas been considerable abuse of the parcel map <br /> provisions. <br /> Comm. Morri said he believes that trying to weigh parcel map <br /> requests against the intent of the person requesting it is not <br /> appropriate for the Planning Commission. He suggested this <br /> proposal be sent back to the Subcommittee. <br /> Comm. Fortney said that he is a banker and is concerned about <br /> financing of parcels. He said he has talked with title companies <br /> and the proposed text amendment would cloud property titles. He <br /> said he also had some concerns about protecting the rights of <br /> legitimate farmers. He suggested the matter be sent back to the <br /> Subcommittee. <br /> Comm. Jungeblut said he has seen and heard all types of lot split <br /> proposals and he did not want to be a judge and jury as to intent. <br /> The previous regulations were not fair to anybody. There is a <br /> problem for the legitimate farmer, but he could not make determina- <br /> tions as to whether a person is or is not a legitimate farmer. He <br /> said he wanted criteria to work with; and he wanted to be fair to <br /> everybody. <br /> Mr. McGrew said that criteria cannot be arbitrarily or it is <br /> illegal. He said the question of clouding the title should be <br /> considered by the Subcommittee. <br /> MOTION: Moved, seconded (Morri-Fortney) and carried by a vote of <br /> 6-0 to continue this item to October 7, 1993 with the hearing open <br /> to consider new criteria; and to refer the matter back to the <br /> Ordinance Subcommittee. <br /> -3d- <br />
