SAN JOAQUIN COUNTY
.•.m.+'.o
r COMMUNITY DEVELOPMENT DEPARTMENT
i
1810 E.HAZELTON AVE.,STOCKTON,CA 9520"232
PHONE:2091468-3120 Fax:209/468.3 63
September 27, 1994
Board of Supervisors
Courthouse
Stockton, CA 95202
Dear Board Members:
PUBLIC HEARING ON TEXT AMENDMENT APPLICATION NO. TA-93-6
OF GEORGE BROWN (COUNTYWIDE)
IT IS RECOMMENDED:
That the Board of Supervisors:
1. Adopt the Negative Declaration; and,
2. Adopt Text Amendment Application No. TA-93-6,
BACKGROUND:
By way of background, staff has received approximately one-half dozen inquires about constructing
ponds, generally as an amenity to a residence, in agricultural areas of the County. The stated purposes
for these ponds would be aesthetics, recreation, raising fish, and water supply for fire suppression and
irrigation. Construction of a pond is permitted under the current code provision. However, the size of the
ponds and the amount of material being excavated would in most cases necessitate removing soils
material from the site.
George Brown, one of the people who inquired to staff about the construction of a pond, filed Text
Amendment TA-93-6. He has worked with staff and the Ordinance Subcommittee to draft the Text
Amendment in its current form.
The Text Amendment would:
• modify Table 9-605.3 of the Development Title to add pond excavations as an accessory
use to be permitted in the AG zone with a Pond Excavation Permit;
add Chapter 9-852 titled Pond Excavation Permits to Division 8 Development Application
Regulations of the Development Title;
• add Section 9-1405.5(g) to the Development Title which would permit removal of soil from
the site when done in accordance with a Pond Excavation Permit; and,
add Chapter 9-1420 titled Pond Excavation Standards to Division 14 Grading and
Excavation provisions of the Development Title.
