REASONS FOR RECOMMENDATION: <br /> The intent of this Text Amendment is to provide standards for removing excess material from property for <br /> the construction of ponds for water supply and recreational purposes. The key points of the development <br /> standards are as follows: <br /> The parcel shall be at least 20 acres in size. <br /> The surface area of the pond shall not exceed two acres. <br /> The pond shall be accessory to an existing residence. <br /> No more than 35,000 cubic yards of material ca be removed from the site. <br /> The maximum depth of the pond shall not exceed 12 feet. <br /> A Certificate of Compliance will be required by a Registered Engineer or a Licensed Land <br /> Surveyor to certify that the pond excavation was completed in compliance with the <br /> approved excavation permit. <br /> A Performance Guarantee shall be required to ensure that the pond is constructed in <br /> accordance with the permit and to provide sufficient coverage to ensure that the site can <br /> be rehabilitated for agricultural purposes in the event the construction of the pond does <br /> not comply with the permit. The bond shall remain in place for a minimum of one year <br /> after the Certificate of Compliance. <br /> The pond shall be designed by a Registered Civil Engineer. <br /> A Grading Permit is required. <br /> The standards that have been developed are intended to address the concerns associated with <br /> constructing ponds, removing material from the site; and, the Farm Bureau's concerns about removal of <br /> agricultural farm land from production. <br /> The Findings to approve a Pond Excavation Permit require that: <br /> (a) The pond is located on non-prime soil or the proposed site contains a unique environmental or <br /> geographic feature that will be retained and preserved as a result of the project. <br /> (b) The excavation will not have a detrimental effect on any surrounding agricultural lands; <br /> (c) Issuance of the permit shall not be significantly detrimental to the public health, safety, or welfare, <br /> or be injurious to the property or improvements in the vicinity. <br /> The pond excavation permit is a discretionary permit that will require a public hearing before the Planning <br /> Commission. As a discretionary permit, it is subject to full CEQA review. Based on the Initial Study that <br /> was prepared fcr this Text Amendment, it was found that the proposal will not have a significant effect on <br /> the environment. <br /> acs ER PACE 2 <br />
