On September 15th the Planning Commission heard the proposed Text Amendment. Russ Matthews of <br /> the Farm Bureau spoke in opposition to the Text Amendment. After considering all oral and written <br /> testimony, the Planning Commission voted 6-1 to approve the Negative Declaration and forward TA-93-6 <br /> to the Board of Supervisors with a recommendation of approval, with modifications to the text as follows: <br /> Section 9-1420.3 Development Standards. <br /> (c) Maximum Cubic Yards. No more than thirty five thousand (35,000 cubic yards <br /> of material can be removed from the parcel. The material shall not be removed <br /> to a site outside of San Joaquin County. <br /> (e) Accessory to a Residence. The pond must be accessory to as the property <br /> owner's primary existing residence. <br /> jy The excavation limits shall be setback a minimum of 200' from prooerty lines. <br /> The requirement for a 200' setback from the pond excavation to a property line is based on anning <br /> Commission's concern that the 200' setback required by Environmental Health from t leach field o the <br /> pond would potentially impact a neighbors use of his property. a normal setbac< o�-r tfie limits of <br /> excavation associated with either an agricultural grading or quarry excavation permit is 25'from a property <br /> line or right-of-way.
