CONDITIONS OF APPROVAL <br /> SU-88-6 (TE-91-9) <br /> Becker and Hamilton <br /> All conditions, unless otherwise noted, shall be met prior to <br /> approval of the final map. <br /> 1. PLANNING DIVISION: <br /> a. In lieu of conveyance of park land to the County, as <br /> prescribed in Section 9-9261 of the Planning Title, the <br /> developer shall contribute fees of equivalent value as <br /> defined in Section 9-9264 . Arrangements for the payment <br /> of said fees shall be approved by County Counsel prior to <br /> final map recordation. <br /> b. Pursuant to Section 66474 . 9 of the Subdivision Map Act, <br /> the subdivider shall defend, indemnify, and hold harmless <br /> the local agency or its agents, officers, and employees <br /> from any claim, action, or proceeding against the local <br /> agency or its agents, officers, or employees to attack, <br /> set aside, void, or annul an approval of the local <br /> agency, advisory agency, appeal board, or legislative <br /> body concerning a subdivision, which action is brought <br /> within the time provided for in Section 66499 . 37 of the <br /> Subdivision Map Act. <br /> C. A noise barrier shall be constructed along East Main <br /> Street for noise attenuations, per Section 9-9411, and it <br /> will reduce noise to a minimum 65 db ldn at the property <br /> line. The details of this noise barrier shall include a <br /> combination of solid wall construction with recessed <br /> planter bays at regular intervals, with trees from the <br /> County Tree List. These trees shall be maintained with <br /> an automatic drip irrigation system or timed sprinkler <br /> system. The height and type of construction material, <br /> with details for any landscaping and irrigation system, <br /> shall be submitted to the Planning Director for approval. <br /> A homeowners ' association shall be established and shown <br /> on the Improvement Plan to ensure ongoing maintenance. <br /> d. All subdivision street names shall be as approved by the <br /> Planning Director. <br /> e. All existing structures shall be removed or shall conform <br /> to setback requirements in the R1-U zone. <br /> 2 . DEPARTMENT OF PUBLIC WORKS: <br /> a. All improvements shall be in conformance with the <br /> Conditions of Approval - 1 - (SU-88-6/TE-91-9) <br />
