1 doing business in the State of California and confined to Defendant's TRUCK TERMINAL activities <br /> 2 in the County of San Joaquin and elsewhere in the State of California. <br /> 3 3. Defendant, with actual or constructive knowledge of this Injunction,only in so far as they <br /> 4 are doing business in the State of California, in the course of Defendant's TRUCK TERMINAL <br /> 5 activities, are pursuant to Health and Safety Code section 25181 hereby permanently enjoined from: <br /> 6 a. Failing to have at all times at least one employee either on facility premises or on <br /> 7 call with the responsibility for coordinating all emergency response measures, in violation of <br /> 8 California Code of Regulations, title 22 section 66262.34(d)(2); <br /> 9 b. Failing to retain a copy of each signed manifest for three (3)years or until the <br /> 10 generator receives a signed copy from the designated facility which received the waste, in violation <br /> 11 of California Code of Regulations, title 22 section 66262.40(a); <br /> 12 c. Failing to submit to the Department of Toxic Substance Control a legible copy of <br /> 13 the manifest with some indication that the generator has not received confirmation of delivery within <br /> 14 sixty (60) days from the date the hazardous waste was accepted by the initial transporter, in violation <br /> 15 of California Code of Regulations, title 22 section 66262.42(c); and <br /> 16 d. Failing to retain a copy of consolidated manifest for at least three (3) years,in <br /> 17 violation of Health and Safety Code section 25160.2(b)(3). <br /> 18 4. Defendant,with actual or constructive knowledge of this Injunction,only in so far as they <br /> 19 are doing business in the State of California, in the course of Defendant's TRUCK TERMINAL <br /> 20 activities, are pursuant to Health and Safety Code section 25515.6 hereby permanently enjoined <br /> 21 from: <br /> 22 a. Failing to complete and/or submit a site map, in violation of Health and Safety <br /> 23 Code section 25505(a)(2); <br /> 24 b. Failing to provide training for all new employees and annual training, including <br /> 25 refresher courses, for all employees in safety procedures in the event of a release or threatened <br /> 26 release of hazardous material, in violation of Health and Safety Code section 25505(a)(4); and <br /> 27 c. Failing to document training electronically or by hard copy and retain for a <br /> 28 minimum of three(3) years, in violation of Health and Safety Code section 25505(a)(4). <br /> -2- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
