Defendant with actual or constructive knowledge of this Injunction, only in so far as they <br /> 2 are doing business in the State of California, in the course of Defendant's TRUCK TERMINAL <br /> 3 activities, are pursuant to California Business and Professions Code, section 17204 hereby <br /> 4 permanently enjoined from: <br /> 5 a. Violating Health and Safety Code sections 25100 et seq., described in paragraph <br /> 6 3—3d above; and <br /> 7 b. Violating Health and Safety Code sections 25500 et seq., described in paragraph <br /> 8 4—4c above. <br /> 9 6. Defendants shall pay to Plaintiff the sum of FOUR THOUSAND DOLLARS ($4,000.00), <br /> 10 as and for civil penalties, pursuant to Health and Safety Code §25515.5. Said payments shall be <br /> 11 delivered to the San Joaquin County Office of the District Attorney,Environmental Crimes Unit, as <br /> 12 per the following: <br /> 13 AT TIME OF SIGNING - $2,000.00 made payable to the SAN JOAQUIN COUNTY <br /> 14 ENVIRONMENTAL HEALTH DEPARTMENT—ENVIRONMENTAL HEALTH DIVISION <br /> 15 TRUST; and <br /> 16 AT TIME OF SIGNING -$2,000.00 made payable to the SAN JOAQUIN COUNTY <br /> 17 OFFICE OF THE DISTRICT ATTORNEY. <br /> 18 7. Defendant shall pay to Plaintiff the sum of ONE THOUSAND DOLLARS ($1,000.00), as <br /> 19 and for civil penalties,pursuant to Business and Professions Code sections 17206. Said payments <br /> 20 shall be made payable to the TREASURER OF SAN JOAQUIN COUNTY and delivered to the San <br /> 21 Joaquin County Office of the District Attorney,Environmental Crimes Unit,AT TIME OF <br /> 22 SIGNING. <br /> 23 8. Defendant shall be penalized,as and for civil penalties, pursuant to Business and <br /> 24 Professions Code sections 17200 et seq., in addition to those civil penalties set forth in paragraphs 6 <br /> 25 and 7, THREE THOUSAND DOLLARS ($3,000.00). However, it is stipulated by all parties that the <br /> 26 entire additional THREE THOUSAND DOLLARS ($3,000.00), in civil penalties shall be stayed for <br /> 27 a period of five(5)years on the following conditions: <br /> 28 a. Defendant will not violate Health and Safety Code sections 25100 et seq., as <br /> -3- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
