6-18-1997 5:50PM FROM THRIFTY OIL CO. 310 861 9796 <br /> (c) To the extent Thrifty (or its agents, <br /> contractors, consultants or employees) prepares or receives <br /> any document of the- types required to be made available to <br /> ARCO' iacrcanC—ler azzar wale nate uvcumeaLs are Initially <br /> delivered or made available to ARCO and prior to the end of <br /> the Subsurface Investigation Period for each Lease Premises, <br /> Thrifty shall provide copies of such additional documents to <br /> ARCO within three (3) business days of receipt thereof by <br /> Thrifty. - <br /> 25.3 .5 Access <br /> (a) On and after the date-of thti— <br /> Agreement, Thrifty shall: (i) grant ARCO reasonable access to <br /> each Lease Premises for the purposes of conducting <br /> inspections; (ii.) arrange for ARCO (or -its agents, attorneys <br /> or consultants) to interview its officers, employees, and <br /> tenants, and instruct all such persons to cooperate fully. with <br /> ARCO ;Cexde tin `- e .rz�cs_rra lorry; (iii) not <br /> object to any interview by ARCO (or its agents, attorneys or <br /> consultants) of any Responsible Government Agency; and (iv) <br /> upon satisfac'E D o t!le CGz1c3Stions set forth in Sections <br /> 10.7, 10. 8, 10. 15 and 11.7, grant ARCO reasonable access to <br /> each Lease Premises for performance of subsurface <br /> investigations. <br /> (b) ARCO (ox its agents, attorneys or <br /> consultants) shall not interview any of Thrifty's officers, <br /> employees, or tenants outside the presence of Thrifty's <br /> authorized representative (s) , and ThriZty shall promptly <br /> facilitate all such interviews at the request of ARCO. ARCO <br /> shall make reasonable efforts to conduct its inspections of <br /> and subsurface investigations on Lease Premises and interviews <br /> of Thrifty' s officers, employees and tenants in such a manner <br /> as to not unreasonably interfere with ongoing business. <br /> (c) ARCO shall be responsible for any <br /> personal injuries or property damage to the extent caused by <br /> or resulting from any inspection or subsurface investigation <br /> that it arranges or conducts at a Lease Premises . <br /> 25.3 . 6 Cost of Subsurface Investigation. <br /> SJI-@LL•xyJla. ..v <br /> Final <br />
