4.1 LAND USE AND PLANNING POLICY <br /> (3) The cancellation is for an alternative use which is consistent with the applicable <br /> provisions of the County General Plan; <br /> Residential uses and PD developments are allowed under the AG-40 General Plan and zoning <br /> designations. <br /> (4) The cancellation will not result in discontinuous patterns of urban development; <br /> The proposed project would result in a planned development that is surrounded by agricultural land and <br /> not part of any existing residential patterns. <br /> (5) There is no proximate non-contracted land which is both available and suitable for the <br /> use to which it is proposed the contracted land be put, or development of the contracted <br /> land would provide more contiguous patterns of urban development than development of <br /> proximate non-contracted land; or <br /> Proximate non-contracted land would have to be of sufficient size to accommodate a similar number of <br /> residential units and a golf course. Non-contracted land in the immediate vicinity is shown on Figure <br /> 4.1-3. Additional non-contracted land is available at a greater distance from the site than what is shown <br /> in Figure 4.1-3. <br /> (b) The cancellation is in the public interest. In order to make this finding,the board shall make al! <br /> of the following findings: <br /> (1) Other public concerns substantially outweigh the objectives of the Williamson Act; <br /> The project offers to maintain valuable oak and riparian woodland as a nature reserve. This unique <br /> resource would be a public benefit. <br /> (2) There is no proximate non-contracted land which is both available and suitable for the <br /> use to which it is proposed the contracted land be put, or development of the contracted <br /> land would provide more contiguous patterns of urban development than development of <br /> proximate non-contracted land; or <br /> See discussion of subfinding(a)(5) above. <br /> 4.1-19 <br />
