4.1 LAND USE AND PLANNING POLICY <br /> The prime agricultural land on the site is not now in production, but underlies the oak and riparian <br /> woodland. This land would be retained as a nature preserve under the applicant's plan. Land that would <br /> be effectively removed from production would be non-prime farmland that is currently used for cattle <br /> grazing. This would be a less-than-significant impact. No mitigation measure is necessary. <br /> Mitigation <br /> t` <br /> 4.1-8 No mitigation measure is required or recommended. <br /> Impact <br /> 4.1-9 Cancellation of a portion of the site under Williamson Act contract could result in <br /> the premature loss of an agricultural resource. <br /> The decision to cancel Williamson Act contracts will be made by the Board of Supervisors after a public <br /> hearing as required by law. In order to approve the cancellation,the Board must find that cancellation <br /> is consistent with the purposes of the Williamson Act, or that cancellation is in the public interest. In <br /> each case, the Board must make certain subfindings,as specified in the Act. The Board will make its <br /> decision based upon all the evidence before it in the cancellation proceedings. The findings ultimately <br /> made by the Board must be supported by substantial evidence in the record of those proceedings. <br /> In order to cancel the contracts, the Board of Supervisors must make the following findings: <br /> (a) The cancellation is consistent with the purposes of the Williamson Act. In order to make this <br /> finding the Board shall make the following findings: <br /> (1) The cancellation is for land which a Notice of non-Renewal has been served pursuant to <br /> Section 51245 of the Government Code; <br /> The property owners have not filed for non-renewal of the contract. However, they have filed an <br /> application to cancel contracts fore a portion of the project site, containing 336.5 acres <br /> (Figure 4.1-4). <br /> (2) The cancellation is not likely to result in the removal of adjacent lands from agricultural <br /> use; <br /> In order to determine the likelihood that cancellation of the project's Williamson Act contracts would r <br /> encourage cancellation on adjoining properties, the EIR consultant conducted a survey of adjacent <br /> property owners. Questionnaires were sent to seven adjacent owners. Four responses were received. <br /> Two of the owners indicated they would not file for non-renewal. One was uncertain and would adopt <br /> a "wait and see" attitude. One indicated that he would be encouraged to file for non-renewal. <br /> 4.1-18 <br />
