Through contacts with The Nature Conservancy and Ifucks <br /> Unlimited, who were (and are) jointly developing the Consumnes <br /> Reserve north of the Brovelli property, Catwil was placed in <br /> contact with Pamela Muick, a highly regarded oak tree expert and <br /> author, who was engaged to develop a resource management plan that <br /> would balance the intended development of the property with its <br /> natural resource base, and provide for appropriate on-site <br /> mitigation for loss of trees and other natural features to be <br /> removed by the development plan. <br /> once preliminary designs were firmed up, applications <br /> were filed with San Joaquin County for the several aspects of the <br /> plan requiring permits, including cancellation, if required, of <br /> all or a portion, of the Williamson Act Contract applicable to the <br /> property. Because the Williamson Act encompasses certain open <br /> space, wildlife habitat and recreational uses, it was not clear at <br /> the outset that the contemplated plan was not consistent with the <br /> Williamson Act Contract. After lengthy discussion with County <br /> Planning Staff and the San Joaquin County Farm Bureau, a decision <br /> was made to seek cancellation of the 336 . 5 acre portion of the <br /> Contract that includes the land upon which the golf course and the <br /> homesites would be constructed, thereby avoiding any potential <br /> expansion of "compatible uses" which might weaken political <br /> support for the Williamson Act, or cause potential increases in <br /> assessed valuation of other Williamson Act properties because of <br /> the potential for other permitted uses of agricultural lands. The <br /> Williamson Act Contract would continue to restrict usage of the <br /> Wm Act Cancellation —3— <br /> June 8, 1993 <br />
