7) Have a preburial agreement. If previously undisclosed archaeological resources are <br /> encountered during construction of any portion of the project,work in the area of the <br /> discovery will cease. The discovered property will be examined by a qualified <br /> professionalarchaeologist,recordedaccordingto accepted contemporarystandards, <br /> and the impacts to the site, if any, must be identified to determine the probability <br /> limits and importance of the resource. Such an evaluation may require limited <br /> subsurface investigation. <br /> If the discovery involves human remains,applicantwill comply with Health and Safety <br /> Code 7050.5 and Public Resources Code 5097. Project work may continue outside <br /> known archaeological resources. <br /> Applicant will consult with the San Joaquin County Planning Commission, and <br /> appropriate and interested Native American Groups, to develop a plan that will <br /> ensure the avoidance,protection,or scientific and respectful removal of the identified <br /> archaeological remains prior to continued project development in the area of the <br /> discovery. <br /> 8) Move any lots that were on midden soils (after the BioSystems survey,two lots were <br /> relocated). <br /> 9) Areas designatedfor storage of excavatedsoil shall not be located on archaeological <br /> sites of the project. <br /> 10) All sewage leach fields shall be excluded form the area of high archaeological <br /> sensitivity. <br /> 11) Native American (Miwok) concerns shall be addressed and development shall be <br /> done with the consultation. An ethnographer shall determine the relationship <br /> between these sites and Miwok oral and traditional history. <br /> 12) A Native American monitor shall be present during all land altering or excavation <br /> activities in archaeological site areas as delineated by BioSystems. <br /> 13) A qualified archaeological monitor shall be present during all land altering or <br /> excavation activities in archaeological site areas as delineated by BioSystems. <br /> 14) As per the BioSystems study, known sites have been mapped by a qualified <br /> archaeologist. <br /> 15) The boundaries of archaeological sites as identified in the BioSystems report shall <br /> be fenced when construction is taking place within 100' of said resources. <br /> 16) A survey of the proposed access road south of the river should be completed to <br /> avoid impact to the previously-recordedtwo sites in the vicinity. <br /> 9 <br />
