Without limiting the generality of the foregoing provisions, prior to entering the <br /> Subject Properties, Licensees, including their contractors and agents,shall <br /> familiarize themselves with the location of the Subject Properties and the location <br /> of any and all Facilities(as defined below) located thereon. After conducting its <br /> work, Licensees agree to restore the Subject Properties and improvements located <br /> on the Subject Properties to substantially the same or a better condition than exists <br /> on the date of this Agreement. In the event that existing monitoring wells or other <br /> permitted or allowed structure or facilities ("Facilities") are utilized, the same <br /> shall be returned to substantially the same or a better condition than exists on the <br /> date of this Agreement. If a Facility is to be abandoned or closed under permit <br /> and with the consent of Licensor, Licensees shall apply for, obtain from the <br /> agency with jurisdiction,and complete the work according to the terms of the <br /> permit. <br /> 8. Licensees further agree that they shall provide to Licensor, at no cost or expense <br /> to Licensor,copies of all reports, data, inspections, tests, and analyses of the <br /> Subject Properties obtained by or for the benefit of Licensees under this <br /> Agreement. <br /> 9. This Agreement shall be binding upon and shall inure to the benefit of the heirs, <br /> successors and assigns of the parties. <br /> 10. The undersigned represent and warrant they each have the full power, right and <br /> authority to enter into this Agreement. <br /> 11. By entering into this Agreement none of the Parties admit any liability or <br /> responsibility for any contamination or other environmental condition of the <br /> 5 <br />
