In determining whether a violation is <br />chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br />violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br />corrective action). <br />(continued from page 1) <br />6. Failed to have an approved UST response plan available onsite (CCR 2712(1), 2634(e)). <br />7. Failed to submit monitoring system certification test report within 30 days for 2017, 2013 (CCR 2638 (d)). <br />8. Failed to submit a written response within 30 days of receiving an inspection report (CCR 2712 (f)). <br />9. Failed to maintain alarm logs and/or follow up actions for the past three years (CCR 2712(b)), <br />10.
