In determining whether a violation is chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including corrective action). Failed to submit monitoring system certification test report within 30 days for 2017, 2013 (CCR 2638 (d)). 8. Failed to submit a written response within 30 days of receiving an inspection report (CCR 2712 (f)). 9. Failed to maintain alarm logs and/or follow up actions for the past three years (CCR 2712(b)), 10. Failed to maintain records of monitoring, repair, and upgrades on site, for the life of the UST (CCR 2712(b)). The site must be brought into compliance immediately to avoid your entire UST system being red tagged 7 -days from the receipt of this Notice.
