In determining whether a violation is chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including corrective action). No fuel shall be deposited into these "red tagged" USTs until these tanks are brought back compliance and "red tags" are removed by the EHD.
