In determining whether a violation is <br />chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br />violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br />corrective action). <br />On October 19, 2018, Zuna Barker of the San Joaquin County Environmental Health Department (EHD) performed a routine <br />underground storage tank inspection at above referenced site. An inspection report was issued identifying actions to be taken to bring <br />this site into compliance, to date no actions to correct existing violations were taken, resulting in a non-compliant status for this facility: <br />1. A routine monitoring system certification was due in September of 2018, to -date this testing has not been completed (CCR 2638(a) & <br />(b),26410)) <br />2. A routine secondary containment testing was completed on April 25th, 2018, to -date a copy of the test report was not submitted to <br />the EHD (CCR 2637(e), 2637(f)) <br />3. The 100 -octane and 110 -octane UST system was found to be illegally abandoned; the operation of these tanks has ceased and they <br />have been "red tagged" since 3-14-2016. No person shall abandon an UST system without complying with the requirements of HSC <br />25298. Immediately obtain a permit from the EHD to remove this abandoned UST system, or place it back into operation and bring it <br />into compliance.
