In determining whether a violation is chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including corrective action). On October 19, 2018, Zuna Barker of the San Joaquin County Environmental Health Department (EHD) performed a routine underground storage tank inspection at above referenced site. An inspection report was issued identifying actions to be taken to bring this site into compliance, to date no actions to correct existing violations were taken, resulting in a non-compliant status for this facility: 1. A routine monitoring system certification was due in September of 2018, to -date this testing has not been completed (CCR 2638(a) & (b),26410)) 2. A routine secondary containment testing was completed on April 25th, 2018, to -date a copy of the test report was not submitted to the EHD (CCR 2637(e), 2637(f)) 3. The 100 -octane and 110 -octane UST system was found to be illegally abandoned; the operation of these tanks has ceased and they have been "red tagged" since 3-14-2016. No person shall abandon an UST system without complying with the requirements of HSC 25298. Immediately obtain a permit from the EHD to remove this abandoned UST system, or place it back into operation and bring it into compliance.
