Said payment shall be due and payable to the aforementioned agency, <br />and shall be delivered to the San Joaquin County Office of the District Attorney, Environmental <br />Prosecutions Unit, on or before January 21, 2005. <br />10. Defendant shall additionally pay to plaintiff the sum of TWO THOUSAND FOUR <br />HUNDRED DOLLARS ($2,400.00), as and for partial cost recovery of the cost of investigation and <br />suit incurred by the San Joaquin County Office of the District Attorney. Said payment shall be due <br />and payable to the aforementioned agency, and shall be delivered to the San Joaquin County Office <br />of the District Attorney, Environmental Prosecutions Unit, on or before January 21, 2005. <br />11. Defendant agrees that at Plaintiffs reasonable request, Defendant will provide <br />documents in Defendant's possession or control to Plaintiff for use as evidence in potential legal <br />actions against third parties who have from time -to -time been retained by Defendant as independent <br />contractors and who are suspected of having violated environmental legal requirements, including <br />but not limited to, independent contractors whom Plaintiff alleges may have worked throughout <br />California without meeting local and state requirements. <br />12.
