FLYING J INC <br /> 333 West Center• North Salt Lake, Utah 84054 <br /> Phone(801)296-7799 • Fax(801)296-7800 <br /> July 3,2008 <br /> Muniappa,Naidu <br /> San Joaquin County <br /> Environmental Health Department <br /> 600 East Main Street <br /> Stockton, CA 95202-3029 <br /> RE: Notice of Violation issued during the Underground Storage Tank and Hazardous <br /> Waste Generator Inspection on June 6,2008 for the Ripon Flying J Travel Plaza. <br /> Dear Mr.Naidu, <br /> This letter is in response to the Notice of Violation issued during an Underground Storage <br /> Tank and Hazardous Waste Generator Inspection on June 6,2008. <br /> HIMonle,to Underground Storage Tank(IJSI)Program Inspection Report dated <br /> June 5.2008: <br /> 1. 7.Facility failed to record all alarms(L9—1129108,LIO—5117108,LJO— <br /> 914107.) This is aviolation of California code of regulation(CCR)section 2712 <br /> (b) Immediately start recording all alarms and how they are resolved. The <br /> three instances listed are from records reflecting 300 days alarm reporting. <br /> With respect to the first and second of the instances referred to on 1/29/08 <br /> and 5/17/08,the O alarm records enclosed clearly show that no alarms <br /> automatically recorded on those dates. Therefore,the alarm records <br /> maintained by the facility are entirely accurate and were appropriately <br /> maintained by the facility's employees. No response action was taken <br /> because there was nothing to which they needed to respond. The third,on <br /> 9/4/07,was misrecorded on 9/5/07,together with the response action taken. <br /> Therefore,during the relevant 300 day period,one of the three noted <br /> instances was a clerical error,and the other two were recorded accurately <br /> and required no action. Flying J has reviewed with our employees the need <br /> for absolute accuracy in recording alarms and the need to correctly note on <br /> the form how the alarms were resolved. <br /> 2. 12. 89 and 91 leak detectors failed 3 gal/hr test at 10 psi. This is a violation of <br /> Health and Safety Code section 25291(b) The service technician changed the <br /> leak detectors(For 91 LD—FX2 V SM 5562, 89 LD—FMV SM 7915.) The leak <br />
